Hey, and welcome to FUPstudio (“FUPstudio”, “we”, “us”, “our”). These Terms & Conditions explain how using our website and buying our digital products works. By accessing our site or purchasing a product, you agree to these Terms.

If you do not agree, please do not use the site or purchase products.

2) ELIGIBILITY
By purchasing from our site, you confirm that you are legally able to enter into a binding contract in your country, or that you have permission from a parent or legal guardian.

3) WHAT WE SELL, DIGITAL ONLY
All products sold on FUPstudio are digital. No physical items are shipped.
After payment, you will receive access to download the files, either instantly or via your order confirmation.

4) LICENSE, WHAT YOU CAN AND CAN’T DO
When you purchase a product, you receive a non exclusive, non transferable license to use it.

You CAN:
Use the files in personal projects.
Use the files in commercial projects, including work for clients, as long as you are not reselling or redistributing the original files.

You CAN’T:
Resell, share, gift, redistribute, upload, or make the files available to others, even for free.
Sell the files as standalone digital items, templates, packs, or bundles, even if modified.
Claim the assets as your own, or remove branding, copyright or attribution notices if included.
Use our products to create competing products that replicate the core value of the files, like “mockup packs”, “brush packs”, “template packs” intended for redistribution.

5) PRICES, TAXES, PAYMENTS
Prices are shown on the website at the time of purchase.
Payments are processed securely via third party payment providers. We do not store full payment card details.

If taxes apply, they may be calculated at checkout depending on your location and the rules in force.

6) EU DIGITAL CONTENT, RIGHT OF WITHDRAWAL
Because these are digital products, once the download starts (or once access is granted), you agree that the service has begun and you may lose the right of withdrawal under EU consumer rules for digital content.

By purchasing, you expressly request immediate performance and acknowledge that you may forfeit your right of withdrawal once the digital content is delivered.

7) REFUNDS, FINAL SALE, EXCEPTIONS
Due to the digital nature of our products, all sales are final and we do not offer refunds, except where required by law.

We may offer a refund or a replacement in cases like:
You received a defective file that we cannot fix within a reasonable time.
You were charged incorrectly due to a technical error.
You accidentally purchased the exact same product twice in the same account (contact us quickly, before downloading if possible).

Download issues are usually solvable. If you have any problem accessing files, email info@fupstudio.com and we’ll help.

8) YOUR RESPONSIBILITY, COMPATIBILITY
Before purchasing, you are responsible for checking that:
Your software and device support the file formats provided.
You know how to import or use the assets in your workflow.

We cannot guarantee compatibility with every app, version, plugin, or device combination.

9) INTELLECTUAL PROPERTY
All website content and all digital products, including designs, graphics, text, previews, and downloadable files, are owned by FUPstudio or licensed to us. All rights reserved.

10) PROHIBITED USE
You agree not to use the website or products for illegal, harmful, abusive, or unethical purposes.
We may suspend access, cancel licenses, or take legal action if we detect misuse, fraud, or redistribution.

11) LIMITATION OF LIABILITY
To the maximum extent permitted by law:
We are not liable for indirect, incidental, special, or consequential damages.
Our total liability for any claim related to a purchase is limited to the amount you paid for the product in question.

We provide products “as is” and do not guarantee that they will meet every specific need, workflow, or third party software update.

12) INDEMNITY
If your misuse of the site or products causes claims or losses for us, you agree to indemnify and hold us harmless, to the extent permitted by law.

13) CHANGES TO THESE TERMS
We may update these Terms from time to time. The latest version will always be posted here with the updated date. Continued use of the site means you accept the updated Terms.

14) GOVERNING LAW, DISPUTES, ODR
These Terms are governed by the laws of Spain.
If a dispute cannot be resolved amicably, the courts of Barcelona, Spain will have jurisdiction, unless mandatory consumer law in your country provides otherwise.

EU consumers may also use the European Commission Online Dispute Resolution platform.
